There seems to be some confusion.
1. Carmen says she has been paying DK and owes a final payment of $1343.34 May 1 but said DK told her to pay us.
2. she wants to be sure that when she pays $1343.34 May 1 that she will have a zero balance (and does not owe $2800)

Thank you!
Denise

Hi Ines,
I am following up on my last payment but realized no one from your company followed back up with me regarding my disposition letter.

The creditor informed me since we had an agreement that I pay you directly for this last payment.
Our agreed payment plan was:

March 1st $1383.34-Paid on time by check

April 1st $1343.34-Paid on time by check

May 1st $1343.34-Will pay on time by check.

Looking forward to hearing from you around what the final amount is because it definitely should not be $2800.

Goo9d afternoon Carmen,

Thank you for your email, it is unfortunate the situation you are involved in right now. Unfortunately, it is not possible to remove any of the penalties for breaking the lease you will need to pay the full amount $4,160, or pay the $3,200 and give us a payment plan for the remaining due amount which will be $960.

Please let us know.

Greetings Esteban,

I read through the whole lease and I reviewed all of our messages. After careful consideration I have decided to vacate on February 29, 2024. I understand that the lease states that we have to pay two months worth of rent and an additional fee of $1000.

My family and I are experiencing financial hardship. We want to resolve this issue amicably and as soon as possible, as such, we would like to request a waiver of the $1,000 fee in exchange for an immediate payment of the two months worth of rent totaling $3,200. I can drop off the check along with the keys on Thursday.

Hi Esteban,

Thanks for your email. I have not broken the lease yet because I have not vacated the property yet. Thus the penalties are null and void until/unless I actually complete the early termination.

Good afternoon Carmen,

Read the lease you signed section “4.6 EARLY TERMINATION

Provided Resident is not in default hereunder at the time of giving notice, has strictly complied with all of the provisions of this Agreement, is current with all fees due Management, Resident may terminate this Lease before the expiration date by: (1) giving Management at least sixty (60) days written notice sent by certified or registered mail, return receipt requested; plus, (2) paying all monies due (rent and costs) through date of termination; plus, (3) paying an amount equal to two (2) month’s rent; plus, (4) return the Premises in clean and ready to rent condition; plus, (5) paying a one thousand dollar fee to Management as the parties agree the precise amount of advertising costs, length of vacancy and other factors are impossible to ascertain at the outset and that the sum set forth in this paragraph is reasonable compensation for breach by the Resident under this paragraph. The foregoing shall not relieve Resident of his/her responsibilities and obligations regarding any damages to Premises. No prorating will be given for percentage of lease term completed by Resident. (b) If Resident vacates the Premises before the Anniversary Date, and fails to follow the Early Termination clause precisely as stated above, this shall be called an abandonment, Resident will be in default of their Lease and damages will include all expenses incurred by the owner, and/or Management, to get the Premise reoccupied, (or to the next Anniversary Date of the lease) including, but not limited to, lost rent to day of reoccupation, utilities and lawn care during vacancy, Procurement Fee and advertising charged the owner to re-rent the Premises, plus property/physical damages from the move-out inspection. Management will aggressively attempt to re-rent the Premises so as to limit damages and Resident will be responsible for the exact costs incurred as a result of Residents abandoning the Premises. Said expenses will be due even if the owner elects to sell the Premises instead of re-renting it.”

Ios not illegal the charges for breaking the lease and YES, you need to pay those they are not going to be removed.

I'm not understanding the penalties that you are assessing off of a presumed move out date. By law it is a courtesy for me to inform you about a move out date and you cannot legally impose penalties for early termination when I have not completed that action. I have paid the rent in accordance with the lease that both of us signed.

Let me know if those penalties are taken away as long as I am paying rent in accordance to the contract we signed.

Good afternoon Carmen,

I´m sorry but this doesn't work like that, why did you request the move-out date on 2/29/2024?, secondly you are breaking the lease and you haven´t paid the penalties that need to be paid before the move-out, the only way we have to change your move out date to March 29 is for you to pay the penalty this week, otherwise, you will be on holdover, and the cost of holdover is a 10% of a full months rent per day, in your case $157.5 per day.

Please let me know how you want to proceed
